Civil Disbursement Fund

Applications for assistance from the Tasmanian Civil Disbursement Fund are now being received.

Tasmanians will now be able to access financial aid for civil cases under the new Civil Disbursement Fund scheme being run by the Legal Aid Commission of Tasmania.

The Fund can receive applications from Tasmanians requiring financial assistance for their civil cases, not just those who would be eligible for legal aid. Rising civil case costs has meant that most people cannot afford to have their case heard before a Court. The Civil Disbursement Fund can help applicants pay up front disbursements and, if the case is won, the applicant repays with a premium those disbursement costs back into the Fund.

The Civil Disbursement Fund will initially provide assistance for serious personal injury claims, workers compensation claims and professional negligence claims with other cases set against competing resources and priorities.

The Fund will provide financial assistance for expenses such as expert reports, medical reports, trial fees, witness's expenses and various other Court expenses. Applications can be made through a lawyer.

The Fund was set up by the Tasmanian Government.

Guidelines and Application Form

Guidelines for the operation of the fund and application forms can be collected from your nearest legal aid office, from the telephone advice service, or downloaded from this page.

Persons who are considering making applications to the fund should be aware that applications will firstly be considered by the committee, then the Commission. Intending applicants are advised that applications need to be received at least one week prior to the committee meeting to be considered.
