Youth Justice Act Matters

6.1 Most matters arising under the Youth Justice Act 1997 are now dealt with out of Court by cautioning and community conferencing. Therefore those matters that are the subject of Court proceedings are considered serious. However, aid will only be granted where there is a probability of serious consequences, (i.e. detention) following a conviction. However, aid may be made available if special circumstances surround the case, or the applicant.
6.2 Aid for a defended hearing or trial will be subject to the Commission's State Merits Test.
6.3 A grant of aid for a Youth Justice Act matter will be given to a Commission practitioner, in preference to a private practitioner, unless exceptional circumstances exist.
