Legal aid guidelines

Overview of guidelines for grants

The guidelines are the rules for determining the granting of legal aid.

After establishing that Tasmania Legal Aid is the appropriate Commission to apply to, the means test determines financial eligibility for aid.

Eligibility is assessed based on matter type in accordance with Commonwealth and State Government guidelines, which may also require an assessment of the merits of the case.

The balance of the guidelines cover administration of the grant and payment of fees to lawyers.

Family law property mediation trial guidelines

Overview of trial guidelines

The Guidelines are the rules for granting legal assistance for the lawyer-assisted Family Law Property Mediation Trial.

The Guidelines apply a different income and assets tests. Contributions may be imposed.

The Guidelines set out the eligibility criteria and conditions for the Mediation Trial, including a work item and fee schedule for lawyers.

Family violence and cross-examination of parties scheme guidelines

Overview of scheme guidelines

The Guidelines are the rules for granting of legal assistance under the Family Violence and Cross-Examination of Parties Scheme (the Scheme).

No means or merits test is applied by these Guidelines.

The Guidelines set out the eligibility criteria and conditions of assistance for the Scheme including work items and fee schedule for lawyers.
